I, the undersigned (the “Participant”) enter into this Agreement, Waiver and Acknowledgement (the “Agreement”), and agree to all the terms and conditions, as a Participant of the Endurance Nutrition Primer program ("Program").
I understand that the Program is a proprietary product created by Dina Griffin ("Griffin") and The Nutrition Mechanic, LLC ("LLC") (Griffin and LLC, collectively, the "Parties") and is created for educational purposes only, to serve as a guide to improving health and performance.
None of the Program Parties are a medical doctor, psychologist, psychiatrist, or therapist and therefore the Program should not replace advice from medical or health professionals in this regard. 
The Program is created and under the guidance of a Registered Dietitian, but is intended for general educational purposes. The Program is not a one-on-one medically-supervised nutrition, weight-loss, health, or performance program. Please consult your doctor or other health care provider for any one-on-one advice or concerns regarding your health, medicines, and conditions—including physical, medical or psychological. 
Participant further understands that the Parties are not responsible for any conclusions drawn by Participant, nor any losses, injuries or illnesses that result directly or indirectly from attempting the recommendations in this program. By participating in the Program, Participant is choosing of his or her own free will to apply any of the presented concepts. Therefore, Participant specifically and completely accepts and assumes the risks inherent in undertaking this Program.
Participant understands and agrees that the Program is solely for Participant’s personal, noncommercial use. No part of the Program may be reproduced or distributed in any form, in any part, or by any means, including worksheet materials, content, videos or audio. Participant agrees that he or she will not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or any other electronic means) any material from the Program or the Parties. Participant understands and agrees that he or she may not screenshot, take photos or share any portion of any of the materials to any social media site, including but not limited to Facebook, Instagram or Twitter. Participant further understands and agrees that duplicating, "sharing" or uploading product content to sharing sites is considered stealing, and that the Parties will prosecute to the full extent of the law. Participant understands and agrees fully that Participant may not use the Program or the information provided in a manner that constitutes an infringement of the rights of the Parties, unless expressly authorized by the Parties, including separately hosted webinars, seminars, social media groups or events using the materials and copyrighted works of the Program and the Parties. 
If Participant is not 100% satisfied within 14 days of Program purchase, Participant will receive a 100% refund after e-mailing Dina Griffin ([email protected]) within 14 days of the initial Program purchase date. 
Participant understands and agrees that the Parties, may at any time, remove Participant and refund the registration amount, if within ninety (90) days of the program beginning. The Parties have the right, at any time, to refund a registration fee and deny participation, present or future, to Participant or any participant for any reason.
In consideration of being permitted by Parties to take part in the Program, Participant agrees to waive, release and discharge any and all claims arising out of the program which Participant may have, or which may hereafter accrue to Participant, as a result of participation in the Program. This release is intended to discharge in advance the Parties from any and all liability arising out of or connected in any way with Participant’s participation in the Program. While there is no inherent risk or dangers with this Program, Participant acknowledges that it is his or her responsibility to consult with a medical professional regarding his or her health at any and all times. If Participant chooses not to consult with a doctor or medical professional, Participant hereby assumes any risks.
